Article 1 – Definitions

  • Entrepreneur: NovaSkinLab, established in Belgium, offering products remotely to consumers.

  • Consumer: a natural person acting for purposes outside their trade, business, craft, or profession.

  • Distance contract: a contract concluded exclusively through one or more means of distance communication.

  • Cooling-off period: 14 calendar days during which the Consumer may withdraw.

  • Right of withdrawal: the Consumer’s right to terminate the contract within the cooling-off period.

  • Day: calendar day.

  • Written: also includes electronic communication (e.g., email).

Article 3 – Applicability

  • These Terms apply to every offer by NovaSkinLab and every distance contract concluded with a Consumer.

  • Deviations are valid only if agreed in writing.

  • If specific product terms conflict with these Terms, the Consumer may rely on the provision most favorable to them.

Article 4 – The Offer

  • Product descriptions are complete and accurate to enable a well-informed decision.

  • Obvious errors or mistakes do not bind NovaSkinLab.

  • Each offer states the total price including VAT, delivery costs (or how they are calculated), and key characteristics.

Article 5 – The Contract

  • A contract is concluded when the Consumer accepts the offer and satisfies the stated conditions.

  • If the Consumer accepts electronically, NovaSkinLab promptly confirms receipt of the acceptance by email.

  • NovaSkinLab may refuse an order with proper reasons (e.g., suspected fraud); if so, any payment is refunded.

Article 6 – Right of Withdrawal

  • The Consumer may withdraw from the contract within 14 days from the day after the Consumer (or a third party indicated by the Consumer) receives the product.

  • To exercise the Right of Withdrawal, the Consumer informs NovaSkinLab of their decision via an unambiguous statement (email is sufficient).

Article 7 – Consumer Obligations During Cooling-Off Period

The Consumer shall handle the product and packaging with care and only unpack or use it to the extent necessary to determine the nature, characteristics, and functioning of the product.

Article 8 – Exercising the Right of Withdrawal and Costs

  • The Consumer shall notify withdrawal via  novaskinlab@gmail.com  or the website contact form and return the product without undue delay and in any event within 14 days of the notice.

  • Return shipping costs are borne by the Consumer unless explicitly stated otherwise.

  • The Consumer is liable for any diminished value of the product resulting from handling beyond what is necessary to establish its nature, characteristics, and functioning.

Article 9 – Obligations of NovaSkinLab upon Withdrawal

  • Upon valid withdrawal, NovaSkinLab refunds all payments received for the product (excluding any additional delivery costs resulting from the Consumer’s choice of a non-standard delivery method) within 5 business days after receipt and inspection of the returned goods.

  • Refunds are made using the same means of payment used for the initial transaction, unless the Consumer agrees otherwise.

Article 10 – Exclusions from the Right of Withdrawal

  • The Right of Withdrawal does not apply to:

  • Products that are not suitable for return for health protection or hygiene reasons and were unsealed after delivery (e.g., opened cosmetics).

  • Products that, after delivery, are inseparably mixed with other items.

Article 11 – Price

  • Prices include VAT unless stated otherwise.

  • Obvious pricing errors do not bind NovaSkinLab.

Article 12 – Conformity and Warranty

  • NovaSkinLab warrants that products conform to the contract and reasonable Consumer expectations of quality and usability.

  • Any commercial guarantee offered does not affect statutory rights under Belgian law.

Article 13 – Delivery and Performance

  • NovaSkinLab exercises due care in receiving and executing orders.

  • Products are delivered within the indicated timeframes. If delivery is delayed, the Consumer will be informed promptly; in case of substantial delay, the Consumer may cancel the order for a refund.

  • Risk of loss or damage passes to the Consumer upon physical delivery to the Consumer or a designated third party.

Article 14 – Duration Contracts: Term, Termination, Renewal

  • If a contract is concluded for an indefinite duration (e.g., subscriptions), the Consumer may terminate at any time with one month’s notice, unless mandatory law provides a shorter period.

Article 15 – Payment

  • Payment is made using the methods offered on the website.

  • The Consumer must promptly report inaccuracies in payment details.

  • In cases of non-payment, NovaSkinLab may suspend performance or charge statutory interest and reasonable collection costs, within legal limits.

Article 16 – Complaints Procedure

  • Complaints about product conformity or performance must be submitted promptly, clearly described, to novaskinlab@gmail.com (preferably within 7 days of discovery).

  • NovaSkinLab responds within 5 business days with a substantive reply or an indication of when a substantive reply will be provided.

  • The Consumer must give NovaSkinLab at least 14 days to resolve the complaint before taking further steps.

Article 17 – Disputes

  • Belgian law governs these Terms and any contracts concluded under them.

  • Disputes shall be submitted to the competent courts of Antwerp, Belgium, without prejudice to the Consumer’s mandatory rights to bring proceedings in their place of residence under applicable EU law.

Article 18 – Sector/Code of Conduct (if applicable)

If NovaSkinLab adheres to a sectoral code of conduct or guarantee scheme, details will be published on the website. Participation does not limit the Consumer’s statutory rights.

Article 19 – Additional or Different Provisions

NovaSkinLab may amend these Terms to comply with legal or operational requirements. The latest version will always be available on www.novaskinlab.be. Changes do not affect existing orders already confirmed unless required by law.
